1. OVERVIEW

These Terms of Service (“Terms”) govern your use of the website and services operated by Milo The Dashie (“we”, “us”, “our”).

By accessing or purchasing from our store, you agree to be bound by these Terms and our Refund Policy and Privacy Policy.

If you do not agree, you must not use our Services.

Our store is hosted on Shopify, which provides the ecommerce platform enabling us to sell our products to you.

2. ELIGIBILITY

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order.

By placing an order, you confirm that all information provided is accurate and complete.

3. PRODUCTS

We make every effort to display product colours and designs accurately. However:

Colours may vary due to screen settings

Products are made to order

Minor variations in placement, print scale or colour tone may occur

Such variations do not constitute defects.

We reserve the right to modify or discontinue products at any time.

4. ORDERS AND ACCEPTANCE

An order constitutes an offer to purchase.

A binding contract is formed only when we send an order confirmation email.

We reserve the right to refuse or cancel orders where:

Payment is not authorised

There is a pricing error

Fraud is suspected

Products are unavailable

If we cancel after payment, you will receive a full refund.

5. PRICING, TAXES & DUTIES

Prices are shown at checkout.

For UK customers:
Prices include VAT where applicable.

For EU customers:
VAT will be applied in accordance with applicable EU VAT rules (including IOSS where relevant).

For non-UK/EU customers:
Import duties, taxes and customs charges may apply and are the customer’s responsibility unless stated otherwise.

We are not responsible for customs delays.

6. SHIPPING & DELIVERY

Delivery times are estimates only.

We are not liable for delays caused by:

Postal or courier services

Customs clearance

Incorrect address details

Events outside our control

Risk passes to you upon delivery to the address provided.

7. REFUNDS, RETURNS & YOUR STATUTORY RIGHTS

7.1 Made-to-Order Products

Our products are custom made to order.
As such, we do not accept returns for:

Incorrect size selection

Change of mind

Incorrect address provided by customer

7.2 Damaged or Faulty Items

If your item is damaged, defective, or misprinted, you must contact us within 30 days of delivery with:

Order number

Clear photographic evidence

If confirmed, we will provide either:

A replacement at no cost, or

A full refund

You are not required to return damaged goods unless requested.

7.3 UK & EU Consumer Rights

Nothing in these Terms limits your statutory rights under:

UK Consumer Rights Act 2015

UK Consumer Contracts Regulations 2013

EU Consumer Rights Directive

If you are a UK or EU consumer, you may have the right to cancel your order within 14 days of receiving goods.

However, this right does not apply to goods that are:

Made to the consumer’s specifications

Clearly personalised

As our products are produced to order, many items will fall within this exemption.

Where cancellation rights apply, you must notify us in writing within 14 days and return goods unused. Return shipping costs are the responsibility of the customer unless the item is faulty.

Refunds will be processed within 14 days of receiving returned goods.

8. INTELLECTUAL PROPERTY

All branding, artwork, graphics, product designs and content on this website are owned by Milo The Dashie and protected by intellectual property law.

You may not reproduce, copy, distribute or commercially exploit any content without written permission.

9. THIRD-PARTY SERVICES

Our store is powered by Shopify. All purchases are made directly with Milo The Dashie.

Shopify is not responsible for product quality, fulfilment or customer service matters.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for:

Indirect or consequential loss

Loss of profit or business

Delays outside our control

Nothing in these Terms limits liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation

Any liability that cannot be excluded under law

11. INDEMNIFICATION

You agree to indemnify and hold harmless Milo The Dashie against claims arising from:

Your misuse of the website

Your breach of these Terms

Your violation of any applicable law

12. GOVERNING LAW

For UK customers:
These Terms are governed by the laws of England and Wales.

For EU customers:
You may also benefit from mandatory consumer protections in your country of residence.

13. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance of changes.
